Unfair Terms in Health and Fitness Centre Membership Agreements

A guide has been developed by Consumer Affairs Victoria that applies to unfair contract terms legislation to health and fitness centre membership agreements.  This guide has been designed to help health and fitness centre operators, legal practitioners and consumer advocates understand how Consumer Affairs Victoria will apply the unfair contract terms legislation to membership agreements.
 
It includes examples of the types of terms that may be considered unfair. However, this is not a definitive list. If you are unsure whether a term in a specific contract could be considered to be unfair, you should obtain independent legal advice. Consumer Affairs Victoria will be actively monitoring compliance with Part 2B in the health and fitness centre industry.  Consumer Affairs Victoria welcomes comments about this guide.
